1. Heard learned counsel for Petitioner and the State.
2. By means of this application, the Petitioner prays for the following relief: -
“It is therefore, prayed that this Hon'ble Court may graciously be pleased to direct the opp. parties particularly the opp. party No.2 to conclude the and finalize the Disciplinary Proceeding No. 03/2019 within short period of time as may be fixed by this Hon'ble Court as the petitioner is going to retire on
31.03.2025.
And pass such other
order/orders, direction/directions as this Hon'ble Court may deem just and proper in the eye of law. And for this act of your kindness, the petitioner as in duty bound shall ever pray”.

It is contended by the learned counsel for the Petitioner that the Petitioner is going to be superannuated from his service in the month of December, 2025 whereas, a disciplinary action is pending against him and the enquiry has not proceed further. The short prayer of the Petitioner before this Court is to issue a direction for disposal of the disciplinary action at the earliest. It is further submitted by the learned counsel for the Petitioner that a representation to that effect is also pending vide Annexure-5 before the Tahasildar, Jatani on 28.11.2024 i.e. Opposite Party No.3.

In view of the above, in absence of any serious objection from the side of the leaned ASC, even otherwise, it is expected that since the concerned employee is going to retire in the month of December, 2025, the disciplinary action shall be completed well before the superannuation in the interest of justice. In the
event, if no legal impediments come on the way, the same be completed within a period of three months.
It is needless to say that the Petitioner shall co- operate with the authority in augmenting the process and its completion of the disciplinary action.
