JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.9 under Section 483 of BNSS praying to grant bail in Crime No.225/2025 of Kunigal Police Station registered for offences under Section 103, 238, 310(3), 249, 140(1), 308(2) and 61 of BNS. 2. Heard learned counsel for petitioner and learned HCGP respondent/State. 3. Learned counsel for petitioner would contend that accused Nos. 3 to 8, 10 and 11 have been granted bail by this Court. There is no involvement of the present petitioner in commission of murder of deceased Nagesh. The accusation against this petitioner is taking supari to kill Nagesh and demanding further money and keeping accused No.3 in captive. The other accused who have been - 3 - HC-KAR NC: 2025:KHC:47119 CRL.P No. 13825 of 2025 granted bail are similarly placed to that of this petitioner. Therefore, the petitioner is entitled for grant of bail on the ground of parity. With this he prayed to allow the petition. 4. Per contra, learned HCGP would contend that accused No.1 gave supari to this petitioner/Accused No.9. This petitioner/Accused No.9 asked more money and kept Accused No.3 in his custody and demanded more money. There is recovery of two long-choppers and one mobile at the instance of this petitioner. The petitioner shared the amount received from accused No.1 with other accused. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused charge sheet and other materials placed on record. 6. There is no accusation against this petitioner/Accused No.9, the allegation of committing murder of deceased Nagesh is against accused Nos.1 and 2. The accusation against this petitioner and other accused - 4 - HC-KAR NC: 2025:KHC:47119 CRL.P No. 13825 of 2025 is taking supari to kill the deceased and demanding further supari amount and keeping Accused No.3 in captive till payment of further amount. The other similarly placed accused have been granted bail by this Court. Therefore, the petitioner is entitled for grant of bail on the ground of parity. There are no criminal antecedents of the petitioner. As the charge sheet is filed, the petitioner is not required for custodial interrogation. 7. Considering the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed: The petitioner/Accused No.9 is granted bail in Crime No.225/2025 of Kunigal Police Station, Tumkuru, subject to following conditions: (i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety - 5 - HC-KAR NC: 2025:KHC:47119 CRL.P No. 13825 of 2025 for the like sum to the satisfaction of the jurisdictional Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case. (iv) The petitioner shall not commit any offence.
