HIGH COURT OF JUDICATURE AT ALLAHABAD CIVIL MISC REVIEW APPLICATION No. - 292 of 2025 Court No. - 92 HON'BLE KSHITIJ SHAILENDRA, J.
1. Heard learned counsel for the parties.
2. This application has been filed seeking review of my order dated 25.07.2025 passed in Writ B No.2221 of 2025 (Giran Singh and 2 others vs. State of U.P. and 12 others) whereby the writ petition was dismissed on the ground of delay/laches of 9367 days.
3. Learned counsel for the petitioners-applicant submits that Smt. Gomti, mother of petitioners, was doing pairvi of the case and since she died on 05.03.2024, the petitioners could not know whereabouts of the case and, therefore, laches may be condoned after reviewing the order passed by this Court.
4. I have considered the submissions made and perused the material available on record.
5. A perusal of order dismissing the writ petition reveals that entire contention raised by the petitioners-applicant in the writ petition as regards the belated filing of the same, as contained in paragraphs 5 to 10 of the writ petition, was reproduced by this Court in its order. At that time also, same grounds were taken i.e. to say that Smt. Gomti died on 05.03.2024 and ex-parte proceedings came in knowledge of the applicants after her death, therefore, the laches may condoned.
6. The Court finds that on similar pleas, the present review application has Versus Counsel for Applicant(s) : Aktar Ahmed Siddiqui Counsel for Opposite Party(s) : Arun Kumar Pandey, C.S.C. Giran Singh And 2 Others .....Applicant(s) State Of U.P. And 12 Others .....Opposite Party(s)
been filed and once the Court has already examined the pleas raised and rejected the explanation as non-cogent, there appears to be no good ground to review order dated 25.07.2025. The order passed by this Court does not suffer from any error apparent on the face of record and this application is beyond the scope of provisions of Order XLVII Rule 1 of Civil Procedure Code, 1908.
7. The review application is, accordingly, rejected. September 16, 2025 Jyotsana CMRA No. 292 of 2025 2 (Kshitij Shailendra,J.) Digitally signed by :- JYOTSANA SINGH High Court of Judicature at Allahabad
