JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioners, arraigned as accused Nos.2 and 3 respectively in Crime No.401/2025 of Marathahalli Police Station, Bengaluru City, have preferred this petition under Section 482 of BNSS, 2023, to release them on anticipatory bail. 2. Heard both sides and perused the material on record. 3. Case is registered on the basis of a complaint lodged by the father of deceased by name Naveen S. - 3 - HC-KAR NC: 2025:KHC:32439 CRL.P No. 10839 of 2025 Kunchur, against accused Nos.1 to 3, for the offence punishable under Section 108, 3(5) of BNS, 2023. 4. The complainant has alleged that his son Naveen S. Kunchur married accused No.1 – Nikhita S. about 6 months prior and since then his wife and her relatives i.e., the petitioners herein were giving him mental torture and being unable to tolerate the same, recording a video which was sent to his son-in-law Prakash through whatsapp, his son committed suicide on 26.06.2025 by slitting his neck. 5. Learned counsel contended that the petitioners are innocent and the entire allegations are false. He contended that the deceased was staying along with his wife separately in Bengaluru, whereas these petitioners are residents of Mysuru, therefore, the allegations that they were torturing the deceased mentally etc., is false and baseless. He submitted that accused No.1 has been granted bail by this Court and petitioners are ready and willing to abide by any conditions. - 4 - HC-KAR NC: 2025:KHC:32439 CRL.P No. 10839 of 2025 6. Learned High Court Government Pleader has contended that the investigation is under progress, statement of Prakash has been recorded and the video clip which was sent by deceased to him has been collected. He contended that the deceased in his dying declaration has stated that petitioners are responsible for him to commit suicide as they have tortured him mentally. Hence, he contended that, if anticipatory bail is granted, petitioners may not cooperate with the investigation of the case and they may tamper with the prosecution witnesses. 7. The petitioners are very much named in the FIR. It is stated that the deceased recorded a video before committing suicide and sent it to one Prakash through whatsapp. The statement of Prakash has been recorded and the video clip has been collected by the Police. The statement clearly discloses that the deceased has named his wife as well as these petitioners as the cause for him to commit suicide as they have tortured him mentally. - 5 - HC-KAR NC: 2025:KHC:32439 CRL.P No. 10839 of 2025 8. Accused No.1 was granted regular bail by this Court in Crl.P No.10336/2025. Hence, grant of bail to the said accused will not come to the aid of the petitioners. Case is under investigation.
