Hussain for the pettioner Sofikul Islam, who has filed this application under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Chunari Police Station Case No. 03/2024 under Section Page No.# 2/2 310(2)/118(1) of Bharatiya Nyaya Sanhita. 2. Heard Mr. R. J. Barua, learned Additional Public Prosecutor, Assam. 3. There was an incident of dacoity and the informant Rakibul Islam went to the Jaleswar Bazar to sell his cattle and while returning home with his unsold cattle accompanied by his friends, he was attacked by a group of 8 to 10 miscreants. Their boat in which they were travelling were attacked by another boat carrying 8 to 10 miscreants. The miscreants attacked the informant and his friends with sharp weapons causing grievous injuries and they snatched away mobile phones and cash of Rs. 5000/ to 6000/- and 11 cows from the possession of the informant. 4. Learned Additional Public Prosecutor has submitted that there are incriminating materials in the Case Diary against the petitioners. 5. I have also scrutinized the Case Diary. Indeed there are incriminating materials in the Case Diary against the petitioners. 6. At this juncture, there appears to be no justified ground to extend the privilege of anticipatory bail to the petitioner. 7. Petition stands rejected at this stage. 8. Send back the Case Dairy.
