The accused was apprehended and the amount was recovered and it was handed over to the defacto complainant. However, subsequently, the accused is elusive and is not residing in the address given and the case is now pending from the year 2018. Considering the nature of the case, and even if in future, warrant is executed, the same will impinge upon the right to speedy trial of the accused and as such, no useful purpose will be served in keeping the matter pending. 4.
