The learned counsel for the petitioner submitted that the properties comprised in S.F. Nos. 174/1B, 174/2, 174/5B, 174/6B, 266/6, 266/14, 266/17, 269/4B, 269/5A, 269/5D, 269/5E, and 478/16 of Periyapatti Village, Namakkal District, were originally owned ancestrally by Chinna Gounder and Kali Gounder. The petitioner is the daughter of the said Kali Gounder. Palanisamy and Subramaniam are brothers of the petitioner herein**,** and by way of succession, the petitioner is entitled to get a 2/3rd share in the above-mentioned property. 3. On verification of the revenue records, it was found that the 3rd respondent, with the help of the 2nd respondent and without issuing any notice to the petitioner, removed the name of the petitioner and mutated the revenue records. Additionally, a civil suit in O.S. No. 207 of 2023 is also pending for the relief of partition. To mutate the revenue records, the petitioner made a representation on 22.02.2025 before respondents 1 and 2 to issue a joint patta for the above-mentioned property. However, based on the patta issued by the 2nd respondent in the name of the 3rd respondent, the 3rd respondent had sold the subject properties in favour of third parties. Hence, the petitioner herein once again made a detailed representation on 17.03.2025 requesting to cancel the patta issued by the 2nd respondent, but the same has not been considered till date. Hence, the petitioner has approached this Court. 4. In reply, the learned Government Counsel appearing for the respondents submitted that the appropriate authority to consider the petitioner’s representation would be the Revenue Divisional Officer (RDO). Therefore, if any representation is made before the RDO, the same will be disposed of by the said official within a period of eight weeks. 5. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents, and also perused the materials available on record. 6. In view of the above, this Court directs the petitioner to make a fresh representation to the Revenue Divisional Officer. In such a event, the RDO is directed to consider the petitioner’s representation on its own merits and dispose of the same in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 17951 of 2025 __________ Page4 of 5 7.
