Learned counsel for the petitioner submitted that the execution application filed by the petitioner was dismissed by the learned Executing Court on 06.05.2025, in view of the judgment passed by a Division Bench of this Court in CWP-19799-2023, titled as Sohan Lal and others versus Union of India and others, decided on 20.03.2025, whereby the provisions of Sections 3G and 3J of the National Highways Act, 1956 were declared constitutionally void but at the same time, the operation of the aforesaid judgment has been stayed by Hon’ble Supreme Court on 30.05.2025 (Annexure P-6) and therefore, he may be permitted to withdraw the present petition in order to enable the petitioner to file an appropriate application/petition before the learned Executing Court in light of the aforesaid facts and circumstances. 2.
