2025:JHHC:11564 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2393 of 2025 Dharmendra Kumar, son of Ashok Saw, resident of village Chainpur, Tola Chatipar, P.O and P.S. Chainpur, District- Palamau, Jharkhand ..... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Anil Kumar, Advocate. For the State : Mr. Tarun Kumar, A.P.P …..... 02/17.04.2025 This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 80 and 3(5) of B.N.S. In connection with Chainpur P.S. Case No. 261 of 2024, pending in the Court of learned SDJM, Palamau. Heard learned counsel for the petitioner(s) and learned APP for the State at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. The petitioner is the husband. Admittedly, the death occurred within a year of the marriage. Further there is allegation of demand of dowry and the death is definitely unnatural as she has committed suicide. Thus all ingredients of Section 80 BNS are present in this case. Considering the nature of allegation, I am not inclined to allow this anticipatory bail application. Accordingly, the prayer for bail of the petitioner, above named, is rejected.
