Also heard Mr. M P Goswami, the learned Additional Public Prosecutor appearing for the State of Assam/respondent No. 1. 2. This is an application under Section 430 of the BNSS, 2023 praying for suspension of sentence as well as for releasing the applicant on bail. 3. The applicant Bappa Deb was convicted by the learned Additional Sessions Judge (FTC) No. 1, Margherita, Tinsukia in Sessions Case No. 259(M)/2013. He was sentenced to undergo rigorous imprisonment for 2 (two) years and 4 (four) years for the offences u/s 324 and 307 of the Indian Penal Code. 4. Mr. Goswami has objected to this bail application. 5. I have gone through the impugned judgment. Therefore, the prayer of the petitioner is Page No.# 3/3 allowed. 6. It is hereby directed that the sentence dated 25.02.2025 imposed upon the applicant by the learned Additional Sessions Judge (FTC-1), (FTC) No. 1, Margherita, Tinsukia in Sessions Case No. 259(M)/2013 shall remain suspended till disposal of the connected appeal. 7. The applicant, Bappa Deb, who was convicted by the learned Additional Sessions Judge (FTC) No. 1, Margherita, Tinsukia in Sessions Case No. 259(M)/2013, is allowed to go on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Additional Sessions Judge (FTC) No. 1, Margherita, Tinsukia.
