For Petitioner(s): Mr. J.Praskasam For Respondent(s): Mr.C.Prabakaran, Government Counsel for R1 to R5 Mr.Durai Gunasekaran , Government Counsel (Crl.Side) for R6 to R8 No appearance for R10 Order This Writ Petition has been filed seeking a direction to Respondents 1 to 5 to consider the petitioner’s representation dated 24.03.2025 and take appropriate action to halt the illegal road construction being carried out by Respondents 9 and 10. 2. The learned counsel for the petitioner submitted that the petitioner’s property, measuring an extent of 32 cents, is situated in S.F.No. 174/2A, Palathuvannan Village, and that the Government has also allotted a separate house site patta in favour of the petitioner in S.F.No. 180/3. While so, the 10th respondent, who owns the adjacent land in S.F.No. 174/1, has been making https://www.mhc.tn.gov.in/judis WP No. 17812 of 2025 __________ Page3 of 5 unlawful attempts to lay an alternative access route through the petitioner’s property as well as the Government land situated behind his house. The 10th respondent has no legal right of pathway through the petitioner’s land; despite this, he has been continuously harassing the petitioner. Aggrieved by these unlawful acts, the petitioner submitted a detailed representation dated 24.03.2025 to Respondents 1 to 4, outlining the illegal activities carried out by Respondents 9 and 10, and requesting immediate intervention to halt the ongoing damage to his patta land. As the said representation has not been considered to date, the petitioner has been constrained to approach this Court. 3. In reply, the learned Government Counsel appearing for the respondents would submit that the petitioner’s representation dated 24.03.2025 will be disposed of by the 4th respondent within a period of six weeks. 4. Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record. 5. In view of the above, this Court directs the 4th respondent to consider the petitioner’s representation dated 24.03.2025 on its own merits and dispose of the same in accordance with law, after conducting a due enquiry.
