Order on Board Per Ramesh Sinha, Chief Justice 12.08.2025 1 Heard Mr. Ashish Shrivastava, learned Senior Advocate assisted by Mr. Rahul Ambast, learned counsel for the petitioner as well as Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State/respondent. 2 The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :- ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA

“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to quash and set-aside the impugned FIR registered vide dated 04.07.2024 (Annexure P/1) in crime no. 0403/2024 for the alleged offences under Section(s) 409, 420, 467, 468, 471 & 120-B of the Indian Penal Code, 1860 against the petitioner, in the interest of justice.” 3 The Director General of Police, Raipur (Chhattisgarh) has filed an affidavit, whereby it has been stated that as the two co-accused are still absconding, hence, the investigation could not be concluded. 4 It has been submitted by learned Senior Advocate for the petitioner that the said two co-accused have already been granted anticipatory bail and the petitioner himself has been granted regular bail long back in the month of August 2024 itself, but till date the investigation has not been concluded. 5 In the present case, the complainant, who has lodged the impugned FIR, has not been made party and on a pointed query being made from learned Senior Advocate, appearing for the petitioner, could not give the satisfactory reply and prays for time to implead the complainant as party-respondent.
6 Accordingly, the instant petition is dismissed for non-joinder of necessary party with liberty to file a duly constituted petition with appropriate parties, subject to depositing a sum of Rs.10,000/-
3 (ten thousand) as cost by the petitioner in the Registry of this Court for wasting the precious time of the Court and the same shall be transmitted to Government Special School for Visually Handicapped Boys and Girls, Jashpur, Chhattisgarh. 7 Certified copy of the documents, if any, annexed with this petition shall be returned to the counsel for the petitioner after retaining photocopies of the same.
