Thereupon the matter had come up on various occasions, but the applicant had not taken steps as regards the respondent No.1. 3. From the above, it appears that the applicant had lost interest in the instant proceedings, for which, the instant application stands dismissed for non- prosecution. 4. Taking into account that the instant application is an application seeking condonation of delay and the instant application having been dismissed for non- prosecution, the accompanying appeal so filed cannot be entertained as it is barred by limitation.
