ORAL ORDER
1. The petitioners are before this Court seeking for the following reliefs; a. Issue a writ of mandamus to the respondents by directing them not to dispossess the petitioners from any portion of the land in Sy.No.125/9 of sulikunte village, varthur hobli, bengaluru east taluk except in accordance with law. b. To award costs of this petition. c. to pass such other order or orders as this Hon’ble court deems fit to grant in the circumstances of the case in the interest of justice and equity. 2. The grievance of the petitioner is that without acquiring the land of the petitioner, a road is sought to be formed in the land of the petitioner bearing Sy.No.125/9 of Sulikunte Village, Varthur Hobli, Bengaluru East Taluk. 3. The respondents have filed a memo indicating that there is already an existing road, which road is now

being designated as a hotspot place for accidents to occur, and by misusing the interim order which has been passed in the present matter, the petitioner is stopping the repair works being carried out. 4. Learned AGA submits that the State is now proposing to widen the existing road to a four-lane road, and insofar as the widening is concerned, any land of the petitioner, if required, would be acquired by following the due procedure. The said submission answers the grievance of the petitioners, which has been raised in the present matter. 5. Insofar as the existing road is concerned, if there are any accidents which are happening and/or if the respondents want to repair the said road, the respondents would be free to do so, since that is an existing road. It is only the land which is proposed to be acquired for widening of the road that cannot be used by respondents for any purpose. - 5 -

6. In that view of the matter, placing the submission of learned AGA on record that any land of the petitioner which is required for the purpose of widening of the road would be acquired by following the appropriate procedures, the petition stands disposed of.
