1. Mr. Lalit Sharma and Mr. Ashish Kumar Jemini, learned counsel for the applicants.

Present applicant–Aditya Saini S/o Jitendra Saini is seeking regular bail in relation to first information report dated 13.05.2025 bearing FIR No.0191 of 2025, Police Station Gangnahar, District Haridwar, wherein the present applicants have been implicated for the offences punishable under Sections 109(1), 115(2), 118(2), 351(3) and 352 of BNS, 2023.
5. It is contended by learned counsel for the applicant that the applicant No.1 and 2 are the real brothers and sons of applicant No.3. All these three applicants were arrested on 25.05.2025. It appears from the case of the prosecution that there is long enmity in between the family members of the applicant and the complainant. Both of them are residing in the same locality and the neighbours. Earlier, an incident was also happened in the year 2024.

Learned counsel for the parties admit this that the dispute is only for the smaller issues relating to parking place since the complainant’s daughter in law is running a clinic and a shop.
7. Mr. Pankaj Joshi, learned AGA also apprise to this Court that the investigation is still going on but fairly submits that the dispute in between the both the parties are for the small issue, therefore, at this juncture, the applicant No.3 who is aged
about 57 years and the father of the applicant No.1 and 2 may be considered for bail so that after being released on bail, he may make some effort to resolve their old enmity with the complainant and his family member.
8. The same suggestion has been given by Mr. Sandeep Kothari, learned counsel for the complainant. Their suggestions are really appreciable. In such an eventuality, learned counsel for the applicant, Mr. Lalit Sharma, also submits that he is not pressing the bail applications of applicant No.1 and 2 and the same be dismissed as withdrawn.
9. Accordingly, without expressing any opinion on the merit of the case, the instant bail application of applicant No.1 and 2 is dismissed as withdrawn and the bail application of applicant No. is allowed.
10. Let the applicant No.3, namely, Jitendra Saini, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
11. It is made clear that after being released on bail, the applicant No.3 will not create any such situation, which harm the complainant and his family members.
