HIGH COURT OF JUDICATURE AT ALLAHABAD SPECIAL APPEAL No. - 794 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE RAM MANOHAR NARAYAN MISHRA, J.
1. The present intra-court appeal is directed against the order of learned Single Judge dated 24.7.2025 by which Writ - A No. 10299 of 2025, filed by the appellant (hereinafter referred to as 'the petitioner') has been dismissed. 2. The writ petition was filed by the petitioner for a writ of mandamus directing the respondents to declare her result on the post of Mukhya Sevika under E.W.S. category, treating her to be a candidate falling in the said category. The learned Single Judge has held that two E.W.S. certificates relied upon by the petitioner were not relevant and were rightly discarded. The first income certificate is dated 27.10.2021 for the financial year 2021- 2022 and its validity was upto 31.3.2022. The last date for filing online application admittedly was 24.8.2022. Thus, the said certificate was not valid on the last date of submission of the application form, i.e. 24.8.2022. Another income certificate dated 7.2.2025 was relied upon by the petitioner at the stage of document verification and it was not valid for financial year 2022-2023, during which the selection took place. Admittedly, the petitioner had not filed E.W.S. certificate for financial year 2022-2023. The advertisement provided that the person should be having valid certificate in support of claim for reservation, whether vertical or horizontal, issued by Competent Authority of a date prior to the last date of submission of the application. 3. As the petitioner claimed reservation on the ground that she belonged to economically weaker section, as per advertisement, she should have possessed valid income certificate for the relevant period and that too issued Versus Counsel for Appellant(s) : Ashish Kumar Pandey, Shyamdhar Pandey Counsel for Respondent(s) : C.S.C., Siddharth Singhal Smt. Aarti Dwivedi .....Appellant(s) State Of U.P. And 3 Others .....Respondent(s)
prior to cut off date prescribed for submission of the application forms. In the instant case, admittedly the petitioner was not having any such certificate, nor any such certificate has been filed along with the writ petition or even in the present appeal. As such, we find no illegality in the action of the Commission in denying benefit of E.W.S. reservation to the petitioner, nor in the judgment of learned Single Judge dismissing the writ petition. 4.
The appeal lacks merit and is accordingly dismissed. September 1, 2025 Jaideep/- SPLA No. 794 of 2025 2 (Ram Manohar Narayan Mishra,J.) (Manoj Kumar Gupta,J.) Digitally signed by :- JAIDEEP BANERJEE High Court of Judicature at Allahabad
