Heard learned counsel for the applicant and learned A.G.A. and perused the record. 2. This application has been filed challenging the impugned order/non- bailable warrant dated 11.08.2025 passed by the Chief Judicial Magistrate, Kushinagar at Padrauna in Criminal Case No. 4761 of 2023 (State vs. Narshing Gupta and others) arising out of Crime No. 293 of 2022 under Sections 323, 504, 506, 308 I.P.C. at P.S.- Khadda, District- Kushinagar against the applicant. 2. A perusal of the record reflects that other accused persons have been granted bail. In so far as the applicant is concerned, allegation of the informant is that he appears in the court proceedings but has not surrendered nor has applied for bail. 3. In view of the aforesaid fact situation, the Court does not find any error in issuance of non-bailable warrant against the applicant by order dated 11.08.2025. 4. However, considering the nature of allegation, the application stands disposed of with the following directions:- (a) The applicant shall surrender before the court concerned within fifteen days from today and shall apply for bail. Narsingh Gupta .....Applicant(s) State of U.P. and Another .....Opposite Party(s) (b) The bail application of the applicant shall be considered on its own merits on or before 15.10.2025. (c) Till 15.10.2025 or decision on the bail application, no coercive action shall be taken against the applicant pursuant to the non-bailable warrant.
