Learned counsel for the petitioner pleads no instructions.

However, learned counsel for respondent No.3-Asset Reconstruction Company India Ltd., submits that this petition had been filed some time in October 2019, assailing the securitisation proceedings solely on the ground that after issuance of notice under Section 13(2) of the SARFAESI Act, Section 13(4) notice was not issued. However, subsequent developments have taken place, inasmuch as, the secured asset has been put to auction and third party rights have thus been created in favour of auction- purchaser. It is also informed by counsel on behalf of respondent No.3 that the secured asset has been put to sale and loan account has since been closed by adjusting the sale proceeds of the secured asset.

3. In the absence of any explanation regarding the delay and laches in approaching the Court and also the subsequent events which have virtually rendered the cause raised herein as infructuous, this Court dismisses this petition as having rendered infructuous.
