ORAL ORDER
1. Learned AGA accepts notice for respondent Nos.1 to
4.
2. Petitioner is before this Court seeking for the following reliefs- (i) ISSUE a writ of certiorari or any other writ or
order or direction, quashing endorsement dated 06.06.2025 Police as per issued by the Respondent No.4 Annexure-J;
(ii) ISSUE a writ of mandamus directing the Respondents-Police Authorities to consider the case Petitioner as per representation dated 16.05.2025 at Annexure-L and to give him clearance and remove his name from rowdy sheeter register as expeditiously as possible, to meet the ends of justice;

(iii) GRANT such other order or direction as deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity. 3. The grievance of the petitioner is that despite there being no criminal proceedings which are pending against the petitioner, the request made by the petitioner on 16.05.2025 for deleting the name of the petitioner from the rowdy sheet list has not been considered favourably and the endorsement dated 06.06.2025 has been issued by respondent No.4 at Annexure J, stating that there is a proceedings in CC No.443/2015, which is still pending. 4. Though the proceedings in CC No.443/2015 has ended in acquittal on 18.06.2024, it is contended that the petitioner has been issuing unnecessary letters/complaints and therefore the name of the petitioner cannot be removed from the rowdy sheet list against the petitioner. - 4 -

5. Such an endorsement cannot be countenanced in law. The rowdy sheet is opened in the name of the petitioner for the alleged threat to the society on account of there being a criminal proceedings filed against the petitioner, but the same has ended in acquittal. During the pendency of that proceedings or thereafter there is no other proceedings which have been taken up against the petitioner which would indicate that the petitioner is a threat to the society or otherwise. 6. The rejection at Annexure 'J' is only on account of the petitioner allegedly having sent certain letters unnecessarily and therefore the application of the petitioner is rejected. Such a ground for rejection is not available for the respondent. The opening of the rowdy sheet and continuing thereof would have to be on the basis of material on record which indicate that the person against whom a rowdy sheet has been opened is a threat to the society and not otherwise.

In the present case, there being no proceedings filed or pending against the petitioner during the pendency of CC No. 443/2015, it cannot be said that the petitioner is a threat to the society as contended by the learned AGA. In that view of the matter, I pass the following -
ORDER (i) The writ petition is allowed.
(ii) The endorsement dated 06.06.2025 issued by respondent No.4 at Annexure J is quashed.
(iii) The respondents are directed to
consider the representation of the
petitioner dated 16.05.2025 at Annexure 'L' in terms of the above observation within a period of 30 days from the date of receipt of certified copy of this order.
