As can be seen from the same, the allegation made against the petitioners herein is that they are land brokers and that they introduced the complainant to one B.J.Ramaswami, B.J.Manjunath and B.J.Chandrappa (accused Nos.1 to 3) and the said persons agreed to sell an immovable property in favour of the complainant and after receiving an advance amount, an unregistered agreement to sale was entered into, in which the petitioners herein (accused nos.4 and 5) affixed their signature as witnesses. However, accused nos.1 to 3 instead of selling the property in favour of the complainant, have sold the same in favour of some other person and also they have failed to return the advance money to the complainant. Based on the said complaint, an FIR has been registered in Crime No.10/2024 which is pending on the file of Additional Civil Judge and JMFC, Devanahalli against the vendors in the agreement as well as the petitioners herein, who are the witnesses. 3. Admittedly, the role of the petitioners as per the complaint is introducing the complainant to the owners of the - 6 - HC-KAR NC: 2025:KHC:45728 WP No. 3057 of 2024 property and have signed the sale agreement as witnesses. The allegations does not disclose any act of cheating or any other offence being committed by the petitioners herein. If at all the complainant has been cheated, it is by accused nos.1 to 3 and not the petitioners herein as per the complaint. 4. As per as the averments in the complaint even if assumed to be true cannot lead to conviction of petitioners herein, the proceedings against the petitioners is liable to be quashed. 5. Hence, the following: ORDER 1. The proceedings against the petitioners herein in Crime No.10/2024 pending on the file of Additional Civil Judge and JMFC, Devanahalli stand quashed; 2.
