This is the first bail application moved by the applicant-Somveer, who is in jail in connection with FIR No.0086 of 2025 dated 29.06.2025, under Sections 18/8 of the NDPS Act, registered at Police Station Pulbhatta, District Udham Singh Nagar. 4. It is contended by learned counsel for the applicant that contraband which has been allegedly recovered from the applicant is 473 gram of opium, which is much less than the commercial quantity. He further submits that there is no criminal history of the applicant. 5. Per contra, learned State Counsel admits this fact and submits that the commercial quantity of opium is 2.5 kg. 6. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 7. Accordingly, the bail application is allowed. 8. Let the applicant-Somveer be released on bail, on his executing a personal bond and furnishing 2025:UHC:6167 two reliable sureties, each of like amount, to the satisfaction of Court concerned.
