Having perused the contents of the writ petition, this Court is of the considered view that the same is not maintainable in the present form. The petitioner, who is claiming himself to be the brother of Dr. Arun Kumar Dutta, has approached this Court with the prayer that the amount to which his deceased brother was entitled to as he laid down his life as COVID warier, be released in favour of wife and children of the deceased.

This Court is of the considered view that the cause, if any, to invoke the jurisdiction of this Court is of the wife and

2025:HHC:6399 children of the deceased. The petitioner has no locus to file and maintain this writ petition, more so, when there is nothing on record to demonstrate that any authorization etc. has been given to the petitioner by the wife and children of the deceased to pursue the case on their behalf. Accordingly, as prayed for, this writ petition is permitted to be withdrawn, with liberty to the wife and children of the deceased that if so advised, they may approach the Court on the same cause. Pending miscellaneous applications, if any, also stand disposed of.
