THIS PETITION, COMING ON FOR DISPOSAL, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: i. Issue a Writ of Certiorari to quash the endorsement dated 27.02.2024 bearing no DCP (CENTRAL)/ CASE/344/2023 issued by the Respondent No.3 vide Annexure-A, wherein the respondents have denied to considered the representation dated 30.09.2023 wherein the petitioner has sought for removal of his name from the “B ROWDY SHEETER" list opened by the Halsuru gate police station ii. Grant such other and further relief as deemed fit under the circumstances of the case. 2. The petitioner is aggrieved by the non-deletion of the name of the petitioner from the “B Rowdy Sheeter” - 3 - HC-KAR NC: 2025:KHC:50532 WP No. 25514 of 2025 list opened by the Halsuru Gate Police Station. The petitioner having submitted an application for such deletion, respondent No.3 on the basis of their report said to have been issued by respondent No.4 on 23.01.2024 that certain cases are pending, rejected the application of the petitioner for deletion of the name of the petitioner from the “B Rowdy Sheeter”. 3. Sri.M.S.Shyam Sundar., learned Senior counsel appearing for the petitioner by relying on earlier order of the Assistant Commissioner of Police dated 01.08.2018 submits that as far back as on that date, there was a direction which has been issued to remove the name of the petitioner from the rowdy sheet, despite which the name of the petitioner has continued. 4. Learned AGA having been called upon on earlier occasion to secure instructions, today on instructions submits that the name of the petitioner had been deleted from the rowdy sheet, in pursuance of the - 4 - HC-KAR NC: 2025:KHC:50532 WP No. 25514 of 2025 order dated 01.08.2018 but however came to be reopened, subsequently, in the year 2019 on account of one other offence having been committed by the petitioner, which proceedings have been subsequently quashed by this Court and as such, as on date there are no pending criminal proceeding against the petitioner. 5. When there are no pending criminal proceedings against the petitioner, I am of the considered opinion that the continuation of the rowdy sheet insofar as the petitioner is concerned is not sustainable. As such, I pass the following; ORDER i. The writ petition is allowed. ii. A certiorari is issued, the endorsement dated 27.02.2024 bearing No.DCP (CENTRAL)/ CASE/344/2023 issued by Respondent No.3 at Annexure-A is quashed. - 5 - HC-KAR NC: 2025:KHC:50532 WP No. 25514 of 2025 iii. Respondents are directed to consider the application of the petitioner for deletion of name of the petitioner from “B Rowdy Sheeter”. If no criminal proceedings are pending, as on that date to delete the name of the petitioner from the “B Rowdy Sheeter” within period of 30 days from date of receipt of copy of this order.
