HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 29649 of 2025 Court No. - 39 HON'BLE ARINDAM SINHA, J.
HON'BLE AVNISH SAXENA, J. Mr. Santosh Kumar Srivastava, learned advocate appears on behalf of respondent nos.2 and 3 (the employer). He raises preliminary objection to maintainability of the writ petition by drawing attention to earlier order dated 30 th October, 2023 of a Division Bench disposing of petitioner's Writ-C no.33776 of 2023. He points out from paragraph-2 in said order, under challenge therein also was letter/notice dated 25th August, 2023 issued by his client. Mr. Parashar Pandey, learned advocate appears on behalf of petitioner and submits, by notices respectively received by the employer on 9th November, 2023 and another notice dispatched to it on 27th August, 2024, his client had made representation for resolution of the disputes, including by appointment of arbitrator. The employer did not act upon it giving rise to his client's cause of action to come before this Court again. It is clear from said order dated 30th October, 2023 (supra), there is no dispute regarding existence of arbitration agreement. Petitioner says he sought resolution of disputes by way of efficacious remedy, directed on said order. Petitioner may have a case on seeking appointment of arbitrator under section 11(6) and (6A) in Arbitration and Conciliation Act, 1996. On above observations, the writ petition is disposed of.
