Order 19/03/2025
1. Petitioners-claimants have filed instant writ petition under Article 227 of the Constitution of India, seeking direction against the Motor Accident Claims Tribunal, Jaipur Metropolitan, Jaipur,
[2025:RJ-JP:12391] (2 of 2) [CW-3728/2025] (for short, 'Tribunal'), to expedite the trial of Claim Case No.532/2023 titled as 'Renu Dixit & Ors. Vs. Bharat Singh & Ors.' and to decide the claim case within a period of six months.
2. Having heard counsel for petitioner and from perusal of the record, it appears that claim petition was filed by petitioners on 31.05.2023, wherein notices have been served upon the non- claimants and reply by the Insurance Company has been filed. Against the Driver and owner, proceedings have been commenced ex-parte. Although, no order-sheets of the Tribunal have been placed on record, to show that proceedings are being delayed by the respondents or are not being commenced effectively, yet considering the fact that the claim petition was filed on 31.05.2023 and proceedings are going on thereupon, this Court is not inclined to issue any directions. However, it is open for petitioners to make a prayer before the Tribunal itself for expeditious trial and not to adjourn the claim petition unwarrantedly.
3. With the aforesaid observation, instant writ petition stands
disposed of.
4. All pending application(s), if any, stand(s) disposed of.
5. A copy of this order be sent to the Tribunal, forthwith.
