Thereafter on the second date when the matter was taken up i.e. 17.9.2018 learned counsel for the appellant informed that the had expired and sought time to implead his legal representatives and the matter was adjourned for 18.3.2019. On 18.3.2019 because there was no representation on behalf of appellant, the appeal was dismissed for non prosecution by co 03.7.2019 the appeal was restored. The order sheets shows that on the very first date of hearing i.e. 25.4.2017 there was no representation on behalf of appellant. Thereafter on the second date when the matter was taken up i.e. 17.9.2018 learned counsel for the appellant informed that the had expired and sought time to implead his legal representatives and the matter was adjourned for 18.3.2019. On 18.3.2019 because there was no representation on behalf of appellant, the appeal was dismissed for non prosecution by co-ordinate Bench of this Court. Vide order dated 03.7.2019 the appeal was restored. It is to be appreciated that very valuable public time of the Court has been expended in affording opportunities to th justice. On the other hand, the appellant has adopted an utterly casual and careless approach. It is clear that neither the applicant counsel are seriously interested in pursuing the present matter. Thus, this Court is left with no other option except to prosecution.
