Petitioner Versus STATE OF HARYANA ...Respondent CORAM: HON'BLE MR. JUSTICE JASJIT SINGH BEDI Present: Mr. Tarun Dhingra, Advocate for the petitioner. Mr. T.P. Singh, Sr. DAG, Haryana. Mr. Sunil K. Tandon, Advocate for the complainant. **** JASJIT SINGH BEDI, J. The prayer in the present petition under Section 483 BNSS, 2023 is for the grant of regular bail in case bearing FIR No.152 dated 21.11.2024 (Annexure P-1) registered under Section 318(4) of BNS, 2023 (Section 61(2) of BNS, 2023 added later on) at Police Station Cyber Crime, Kurukshetra. 2. The learned counsel for the petitioner contends that a compromise has been arrived at between the parties as is evident from the affidavit dated 26.04.2025 (Annexure P-2). As the petitioner is in custody since 21.04.2025 but none of the 07 prosecution witnesses have been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, he is entitled to the concession of bail. JITESH LAL 2025.08.21 14:21 I attest to the accuracy and integrity of this document CRM-M-43784-2025 -2- 3. The learned counsel for the State, on the other hand, contends that as the allegations pertained to cyber fraud, the petitioner is not entitled to the concession of bail. He, however, concedes that the petitioner is in custody since 21.04.2025 and that none of the 07 prosecution witnesses have been examined so far. 4. Mr. Sunil K. Tandon, Advocate has put in appearance on behalf of the complainant and has filed his power of attorney. The same is taken on record. He admitted the factum of compromise and states that the complainant has no objection, if the petitioner is granted the concession of bail. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 21.04.2025 but none of the 07 prosecution witnesses have been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 7. Thus without commenting on the merits of the case, the present petition is allowed and petitioner-Chanderbhan Singh Yadav S/o Rajender Parsad is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. JITESH LAL 2025.08.21 14:21 I attest to the accuracy and integrity of this document CRM-M-43784-2025 -3- 8. The petition stands disposed of.
