Deepak Kumar had applied for renewal of the same with Indian Consulate at Berlin, Germany on 22.11.2023 i.e. after more than three years from the date of expiry of his passport. 2.1 It is further noticeable that earlier Sh. Deepak Kumar, had filed a writ petition (CWP-968-2025) before this Court wherein, the following order dated 17.02.2025 was passed :- “1. Prayer in the instant civil writ petition filed under Articles 226/227 of Constitution of India is for issuance of a writ in the nature of mandamus for directing respondents No. 1 to 3 to renew/issue passport of the petitioner. 2. Learned counsel appearing for respondents No. 1 to 3 has raised preliminary objection that the present petition has not been filed by attaching duly embossed power of attorney of the petitioner. 3. Learned counsel for petitioner does not dispute the aforesaid fact and submits that he may be permitted to withdraw the present writ petition at this stage with liberty to file a fresh one by attaching duly embossed power of attorney of the petitioner. 4. Dismissed as withdrawn at this stage with liberty aforesaid. 5. Pending applications(s), if any, shall also stand closed.” 3. Considering the afore-mentioned facts, in my considered view, the present writ petition for seeking renewal/re-issuance of passport of Sh. Deepak Kumar is not maintainable at the instance of the present petitioner-Saroj Rani (mother of Sh. Deepak Kumar), moreso, when the instant writ petition has not been filed by Smt. Saroj Rani, in the capacity of an attorney holder on behalf of Sh. Deepak Kumar. 4. Accordingly, the instant writ petition fails and the same is, GURPREET KAUR 2025.08.13 10:24 I attest to the accuracy and authenticity of this order/judgment High Court, Sector-1, Chandigarh hereby, dismissed. 5.
