Considering the fact the applicant is languishing in jail since 22.10.2024, this Court proceeds to hear the matter with the assistance of learned State counsel. 2. This is the First bail application filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in MANPREET KAUR Digitally signed by MANPREET KAUR Date: 2025.02.21 15:57:11 +0530 2 connection with Crime No. 372/2024 registered at Police Station New Rajendra Nagar, Raipur, District Raipur (C.G.) for the offence punishable under Sections 296, 115(2), 351(2), 109, 3(5) of the BNS and Section 25 and 27 of the Arms Act. 3. Case of the prosecution, in brief, is that complainant has made complaint to the concerned police station alleging that at the time of incident, there was simple dispute in between both parties and thereafter, the accused persons have committed marpeet with injured person. Based upon such complaint, the police station has registered the offence under section 296, 115 (2), 351(2), 109, 3(5) of Bharatiya Nyay Sanhita and section 25 and 27 of Arms Act against the accused persons and applicant. 4. Learned State Counsel submits that the applicant Sumedh @ Sumre Humen assaulted the complainant Ashutosh Sarkar using sharp knife due to which, the complainant is stated to have sustained grievous injuries which are serious in nature and there was possibility of his death. Further, the medical documents goes to show that injured was admitted in Navkar Hospital and Research Center from 24.09.2024 to 29.09.2024 and got treatment. Also, the alleged knife has also been recovered at the instance of the applicant, hence his bail application is liable to be rejected. 5. Considering the submission advanced by learned State counsel and from perusal of the records, it transpires that applicant Sumedh @ Sumre Humen assaulted the complainant Ashutosh Sarkar using sharp knife due to which, the complainant sustained grievous 3 injuries on the right upper chest which are serious in nature and further, the medical documents goes to show that injured was admitted in Navkar Hospital and Research Center from 24.09.2024 to 29.09.2024 and got his treatment done and the alleged knife has also been recovered at the instance of the applicant, hence this Court is of the opinion that it is not a fit case to enlarge the applicant bail as such, the bail application of the applicant is rejected. 6. Accordingly, the bail application of the applicant- Sumedh @ Sumre Humen filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 372/2024 registered at Police Station New Rajendra Nagar, Raipur, District Raipur (C.G.) for the offence punishable under Sections 296, 115(2), 351(2), 109, 3(5) of the BNS and Section 25 and 27 of the Arms Act, is rejected at this stage. 7. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 8.
