K This Writ Petition was filed questioning the action of the 3^^ respondent in attempting to dispossess the petitioner herein by highhandedly from the petitioner’s property situated in an extent of 200 square yards in old Sy.No.76, 76-B, 77, 75/2, now the new Sy.No.175/4, 5, 6, 7 of Gambheeram Village, Anandapuram Mandal, Visakhapatnam District. 2. On the other hand, the learned Assistant Government Pleader, relying upon the counter filed by the 3'^'^ respondent, submits that the petitioner has purchased the plot in R.S.Nos.175/4, 175/5, 175/6, and 175/7 of Gambheeram Village through a registered document. However, the petitioner tried to construct a house in Sy.No.175/9 of Gambheeram Village, Anandapuram Mandal, which cannot be permitted as it is classified as 'Vagu' in the Revenue records and it is an objectionable Poramboke. 3. 4. In view of the above said facts and circumstances, as per the counter filed by the 3^^ respondent, it is stated that they are not interfering with the purchased plots of the petitioner in R.S.Nos.175/4, 175/5, 175/6, and 175/7 of Gambheeram Village. However, the 3'^^ respondent has raised an objection to the petitioner’s attempt to construct a house in Sy.No.175/9, which is classified as ‘Vagu’ and it is an objectionable Poramboke. Hence, the 4 3'^^ respondent is entitled to protect the Vagu Poramboke in Sy.No.175/9 of Gambheeram Village, Anandapuram Mandal, and the petitioner shall not raise any construction in the said Vagu Poramboke area. Accordingly, this writ petition is disposed of. Interim order, if deemed to have been vacated. There shall be no order as to costs. 5. any. As a sequel.
