ORDER This Criminal Miscellaneous Petition has been filed by the petitioner, seeking suspension of sentence imposed by the learned Sessions Judge (FAC), Special Court to deal with cases related to POCSO Act, Dharmapuri, https://www.mhc.tn.gov.in/judis
Crl.M.P.No.16193 of 2025 in Crl.A.No.1341 of 2025 in Spl.S.C.No.309 of 2023 dated 25.07.2025, and enlarge the petitioner on bail pending disposal of the above appeal.
2. The petitioner, who is an accused in Spl.S.C.No.309 of 2023, was convicted and sentenced by the learned Sessions Judge (FAC), Special Court to deal with cases related to POCSO Act, Dharmapuri, vide judgment dated 25.07.2025, as follows: Rank of the accused Conviction under Section Sentence awarded Sole accused 5(m) 5 (i) read with 6 of POCSO Act to
undergo
rigorous imprisonment for a period of 20 years and to pay fine of Rs.25,000/-. I/d to undergo one year simple imprisonment.
33(8) of POCSO Act r/w Rule 9 (2) of POCSO Rules, 2020 To pay compensation of Rs.5,00,000/- to the victim girl.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.
