The instant bail application has been filed on behalf of the applicant Jaichandra with a prayer to release him on bail in Case Crime No.75 of 2025, under Sections 109(1), 115(2) and 351(3) B.N.S., Police Station Aichora Kamboh, District Sambhal, during pendency of trial. 5. Learned counsel for the applicant has submitted that the applicant has not committed any offence. Main role of involvement has been assigned to co- accused Pintu in the first information report. It has been stated in the F.I.R. that Pintu has caused knife injury on the neck of Nasir but in the statement recorded under Section 183 B.N.S.S. the injured Nasir stated that all the three accused persons Pintu, Jaichand and Ankt stopped him and they started causing injury by sticks and knife. Thus no specific role has been assigned to the accused Jaichand in his statement. Injury no.1 is incised wound, was caused on the left side of neck of the body of the injured. Other four injuries were of abrasion. It is next submitted that accused applicant is the father of the main accused Pintu that is why he has been falsely implicated due to village politics. criminal history of four cases to his credit and is languishing in jail since
30.06.2025. In case, the applicant is released on bail, he will not misuse the liberty of bail. 6. In case the applicant is released on bail he will again indulge in similar activities and will misuse the liberty of bail. 7.
Having considered the submissions of the parties noted above, finding force in the submissions made by the learned counsel for the applicant; keeping in view uncertainty regarding conclusion of trial; one sided investigation by police, ignoring the case of accused side; applicant being under-trial having fundamental right to speedy trial; larger mandate of the Article 21 of the Constitution of India, bail application is allowed. 8.
