JUDGMENT

By means of the instant petition, the petitioner seeks the following reliefs:- I. Issue a writ in nature of mandamus or any other appropriate writ order directing the Respondent no.3 not to coerce and force the Petitioner to shut its convenience store namely the “New Shop” situated at Ground Floor, KSR Tower, Mossoorie Road, Near Max Hospital, District – Dehradun, Uttarakhand – 248009 and its operation after 10:00 PM; OR IN ALTERNATE, if any, such permission for 24 x 7 operation is required as per the law; II. Issue writ in the nature of mandamus or any other appropriate writ order directing Respondent No.1, 2 and 3 to consider representation of the Petitioner and grant such permission in accordance with law in respect of the convenience store of the petitioner namely the “New Shop” situated at Ground Floor, KSR Tower, Mussoorie Road, Near Max Hospital, District –Dehradun, Uttarakhand – 248009 and its operation; III. Issue any other suitable writ, order or direction of any nature in favour of petitioner, which this Hon’ble Court may deem fit and proper in the present circumstances of the case. IV. Award the cost of writ petition in favour of petitioner.

2. Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner submits that the petitioner is running a ‘Convenience Store’ (“the store”) at Ground Floor, KSR Tower, Mussoorie Road, Near Max Hospital, District – Dehradun, Uttarakhand. But, the respondent no.3/the Station House Officer, Rajpur Police Station, District Dehradun arbitrarily imposing closing hours conditions and preventing the petitioner from running its store beyond 10:00 PM despite the fact that there is no such restriction imposed under the law. Therefore, the petitioner is before this Court.

Learned counsel for the petitioner submits that the Uttarakhand Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 or any rules made there under does not make any closing hours for the store like petitioner. He submits that the respondent no.3/the Station House Officer, Rajpur Police Station, District Dehradun forces the petitioner to close its store beyond 10:00 PM. Hence, directions may be issued.

Learned State Counsel, under instructions, submits that the respondent no.3/the Station House Officer, Rajpur Police Station, District Dehradun has never forced the petitioner to close the store beyond 10:00 PM. He has tendered the written instructions received from the SSP, Dehradun. Let it be taken on record.

6. In view of the statement given by the learned State Counsel, nothing survives in this petition. It stands disposed of accordingly.
