JUSTICE ANIL KUMAR SINHA ORAL ORDER 2 22-01-2025 1. Heard the parties. 2. Petitioner seeks regular bail in connection with Roshna P.S. Case No. 21 of 2024 dated 23.05.2024 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022. 3. As per the first information report a total quantity of 744 liters of Beer has been recovered from an AC Gold Magic vehicle bearing Registration No. BR11GF-1840 and the Police apprehended the driver of the vehicle namely, Raj Kumar Mandal (i.e. the petitioner). 4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case by the Police with oblique motive. He submits that the petitioner is a part time driver and he was unaware about the Patna High Court CR. MISC. No.89137 of 2024(2) dt.22-01-2025 2/2 consignment of Beer loaded on the vehicle in question. The petitioner has got no criminal antecedent and he is in custody since 24.05.2024. 5. Regard being had to the submissions made by the parties, taking into consideration the period of custody and the fact that the petitioner is having no criminal antecedent, I am inclined to grant regular bail to the petitioner. 6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Exclusive Excise Court No. 2, Katihar in connection with Roshna P.S.
