CHIEF JUDICIAL MAGISTRATE, BENGALURU CITY, AT ANNEXURE-B, BY ALLOWING THIS APPLICATION FILED BY THE PETITIONERS.

ORAL ORDER Petitioners are seeking to quash the FIR lodged with Kamakshipalya Police Station by respondent No.2 in Crime No.378/2025 for the offence punishable under Section 64, 69, 352, 351(2) r/w 3(5) of the BNS,2023.
2. Respondent No.2/defacto complainant has alleged that she got acquainted with petitioner No.1 in the year 2016 and the petitioner with a promise of marriage developed a physical relationship with her from 2021 and thereafter, cheated by refusing to marry her. The petitioners Nos.2 to 5 are the parents and relatives of petitioner No.1.

3. Petitioner No.1 and respondent No.2 are present before the Court. A joint affidavit is filed signed by them and the respective learned counsel. It is stated that they have resolved all the disputes amicably and respondent No.2 is not interested to prosecute the case and she has no objection to quash the proceedings.
4. Para Nos.1 to 7 of the joint affidavit are extracted hereunder:
“1. We state that we are the Respondent No.2 and first petitioner in the above petition and know the
facts and circumstances of the above matter. Hence, we are swearing to this Affidavit.
2. We state that we are in mutual relationship with each other and in the said relation due to misunderstanding some strain in the relation developed which led to filing of the complaint against the petitioners herein. Now we have resolved all our disputes amicably.
3. I, Shreedevi, the second Respondent in the above case state that in view of the harmonious relationship developed by settling all the disputes, I being the complainant doesn't want to prosecute the case and if the proceedings are allowed to continue it will hamper our respective life. The

said compromise has occurred out of my free will and consent. We both have also decided that after finishing my studies we may get married to each other.
4. I, Shreedevi, the complainant state that I am pursuing CA and busy with my studies and doesn't want to come to Trial Court and face the Trial if chargesheet is filed in this case. I have taken this decision after much deliberation. I want to withdraw all the allegations. Hence, I pray to close this case.
5. Therefore, we humbly submit to this Hon'ble Court to kindly quash investigation and the entire proceedings in Cri. No.0378/2025 pending on the file of L ACJM, Bengaluru City in the interest of justice and equity.
6. We state that, we being two consenting adults have entered into this affidavit out of our free will and volition without any coercion and force from anybody.
7. We state that and verify that all averments made in this Joint Affidavit are true and correct to the best of our knowledge, information and belief.”
5. The offences alleged though non-bailable in nature, respondent No.2 has stated that the matter has been resolved amicably and she is not interested in

proceeding with the matter any further. In view of the same, no purpose will be served in continuing the proceedings initiated against the petitioners. It is therefore, expedient to quash the proceedings, in the interest of justice. Accordingly, the following:
ORDER Petition is allowed. The entire proceedings arising out of FIR in Crime No.378/2025 of Kamakshipalya Police Station, Bengaluru City against the petitioners are quashed.
