Learned counsel for the parties submits that the parties are present in Court and that they have interacted with each other and have amicably settled their issues.

Learned counsel for respondent No.3 submit that as per the amicable settlement arrived at between the parties, the property in question will remain in the name of the petitioner-Manju and she will remain the owner of the property in question but till the senior citizens are alive, the said property will be used by the senior citizens for their own purpose exclusively to the exclusion of Manju and her husband.

Learned counsel appearing on behalf of the petitioner submits that the said condition put by the senior citizens, is acceptable to the NISHA 2025.05.02 12.04 I attest to the accuracy and integrity of this document
CWP-21995-2023 -2- petitioner. Learned counsel for the petitioner submits that the vacant possession of the house will be given on 1st November, 2025 to the senior citizens for their occupation and residence.

Keeping in view the above, as the parties have already settled their dispute, in terms of the condition, which have been mentioned hereinabove and have been acknowledged by the respective parties before the Court, the present petition is disposed of in terms of the said settlement between the parties. The parties will not get the impugned order executed but will be bound by the above-mentioned amicable settlement which have been arrived at between them.

Till the property is vacated by the petitioner, they will keep on paying a sum of Rs.5,000/- to the senior citizens but after the possession of property is handed over by the petitioner to the senior citizens, the said financial assistance will not be given by the petitioner any further to the senior citizens.
