1. Instant petition, under Section 528 of the BNSS, 2023 has been filed by petitioners, seeking quashing of order dated 28.07.2025 (Annexure P- 3) passed by the learned Additional Sessions Judge, Moga, whereby their bail was cancelled, bail/surety bonds were forfeited to the State and warrants of arrest were issued, in case bearing FIR No.143 dated 20.07.2020, registered against them for the commission of offences punishable u/s 392 IPC and Sections 25 and 27 of the Arms Act, 1959, Police Station Dharamkot, District Moga.

Learned counsel for the petitioners submits that petitioners were regularly appearing before the learned trial Court, but on some occasions, when they could not appear, applications seeking their personal exemption from appearance in the Court were filed, which were allowed by the Ld. trial Court. On 28.07.2025, their absence was not intentional but was on account of some misunderstanding operating in their mind with regard to the next date of hearing.

Learned counsel submits that in the interest of justice one opportunity be afforded to the petitioners, who undertake to appear before the learned trial Court on the date fixed i.e. 10.09.2025 as also regularly attend Court proceedings in future.

5. Present petition is disposed of with a direction to both the petitioners to appear before the Court concerned on or before 10.09.2025. On their appearance, if they move application(s) for grant of bail, the same shall be decided expeditiously by the learned trial Court after giving notice to the complainant.
