The defacto complainant is present before the Court, she submits that the accused is the brother of her husband his whereabouts are not known for the past nine years. She submits that the situation does not exist and she has moved on and the case can be closed. In view thereof, even if the respondent police apprehends the accused and he has got to face the trial, the same would be impinging upon the right to speedy trial of the accused and no useful purpose will be served by keeping this matter pending.
