Neutral Citation No. - 2025:AHC:12671 Court No. - 77 Case :- APPLICATION U/S 482 No. - 31363 of 2024 Applicant :- Neetu Opposite Party :- State Of U.P. And 5 Others Counsel for Applicant :- Rajesh K.S. Chaudhary Counsel for Opposite Party :- G.A. Hon'ble Arun Kumar Singh Deshwal,J. 1. Learned counsel for the applicant is permitted to correct the prayer clause, during the course of the day. 2. Heard Sri Rajesh Kumar Chaudhary, learned counsel for the applicant and Sri Brijesh Kumar Dwivedi, learned AGA for the State. 3. The present application has been filed to direct the learned court below to conclude the trial of Complaint Case No.352 of 2021 (Pramod Kumar Vs. Devendra Singh Raghav), u/s 498A, 323, 504, 506 IPC, Police Station-Sasni Gate, District-Aligarh, pending before learned Judicial Magistrate, Court no.3, Aligarh, within a stipulated period. 4. Contention of learned counsel for the applicant is that complaint in question has been pending since 2021 but it could not be proceeded because of non-cooperation of the accused persons though, the court below has also issued warrant against the accused persons. Though, the Apex Court in the case of High Court Bar Association Allahabad Vs. State of U.P. and others in Criminal Appeal No.3589 of 2023 had observed that High Court should not normally direct to decide the trial in a time bound manner but considering the fact that impugned proceeding has been arising out of the offence against the women, therefore, it is expected from the court below that it will conclude the trial, as expeditiously as possible. 5. With the aforesaid observation, present application is disposed of. Order Date :- 24.1.2025 S.Chaurasia Digitally signed by :- SHUBHAM CHAURASIA High Court of Judicature at Allahabad
