In support of this submission, reliance is placed on Annexure P-6, an enquiry report by the DSP, Karnal. Learned counsel further argues that the trial Court erred in denying bail to the petitioners solely on the ground that they allegedly owed a sum to the complainant, as purportedly indicated in an affidavit submitted by three persons, namely, Ashok Anand, Ram Sehgal and Paramjeet Sehgal.”
3.
Learned counsel for the petitioners submits that in compliance of order dated 17.02.2025, the petitioners have joined investigation and cooperated with the investigating agency.
4.
Learned State counsel, on instructions, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for their custodial interrogation. However, learned counsel appearing on behalf of the complainant has vehemently opposed the prayer and submissions made by the counsel for the petitioners in view of the serious allegations against them.
5.
I have heard learned counsel for the parties and perused the material placed on record.
6.
Since the petitioners have joined investigation and cooperated with the Investigating Agency, the instant petition is allowed and interim
order dated 17.02.2025, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
