HIGH COURT OF JUDICATURE AT ALLAHABAD PUBLIC INTEREST LITIGATION (PIL) No. - 2510 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE ARUN KUMAR, J.
1. The petitioner has filed the instant writ petition ostensibly in public interest seeking a direction to ensure that the road is reserved for public utility and to get the same vacated from the encroachers.
2. Learned standing counsel appearing for the State-respondents and Shri Shanti Dhar Dwivedi, Advocate appearing for respondent No. 4 submit that the petitioner has no locus to file the present writ. It has also not disclosed its credentials as per High Court Rules.
3. We find that the petitioner is alleged to be a body registered at Lucknow. Shri Jagjit Singh who has filed affidavit in support of the writ petition is also resident of Lucknow whereas the road from which the petitioner is seeking removal of encroachment, is situated in district Jaunpur. As the petitioner has failed to disclose his credentials, therefore, we are not inclined to entertain the issue at the behest of the petitioner.
4. The writ petition is dismissed. However, dismissal of the writ petition shall not be treated to be expression of any opinion regarding existence of any encroachment over the subject land or the action of the State- respondents in allegedly failing to redress the grievance sought to be raised herein. The same is left open for being considered at the behest of the proper person. September 15, 2025 Mukesh Kr.
