WPCRL No.736 of 2025 Hon’ble Pankaj Purohit, J.
Mr. Amanjot Singh Chadha, Advocate for the petitioner.
2. Mr. B.C. Joshi, A.G.A. for the State.
3. By means of this writ petition, the petitioner has sought the following reliefs:-
“I. Issue a writ of mandamus directing the immediate transfer of investigation in the FIR No.0185/2025 P.S. Rajpur dated 15/06/2025 District Dehradun U/S 115(2), 324(4) and 351(2) BNS 2023 registered by complainant Bunny Rana (Annexure NO 01) to the Central Bureau of Investigation (CBI) or alternatively to a Special Investigation Team (SIT) constituted under the direct supervision of this Hon’ble Court.
II. Issue an appropriate writ, order or direction for the preservation, seizure, and custody of all CCTV footage from the incident site and Raipur Police Station.
III. Issue an appropriate writ, order or direction exercising inherent jurisdiction under Article 226 to quash the false FIR No.0183/2025 P.S. Raipur dated 15/06/2025 District Dehradun U/S 115(2), 351(2), 352 and 356(2) BNS 2023 (ANNEXURE NO 03) against the petitioner.”
4. From bare perusal of relief claimed by the petitioner, it appears that relief no.1 is in respect of FIR No.0185 of 2025 dated 16.06.2025 lodged by one Bunny Rana in Police Station Raipur, District Dehradun, under Sections 115(2), 324(4) and 351(2) of B.N.S. 2023, in which incident the petitioner allegedly sustained injuries while prayer no.3 is in respect of a FIR No.0183 of 2025 dated 15.06.2025 under Sections 115(2), 351(2), 352 and 356(2) of B.N.S. 2023 registered at Police Station Raipur, District Dehradun lodged by respondent no.4-Rajni Rawat alias Ram Bahadur against the petitioner.
5. From the reading of the relief clause it appears that two cause of actions have been joined together by the counsel for the petitioner, in the present writ petition.
6. In this view of the matter, this Court is unable to exercise the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India.
7. Accordingly the writ petition is dismissed in limine.
