1. Petitioner has filed instant petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.49 dated 31.03.2025 under Sections 115 (2), 75, 76, 190, 324 (4) of Bharatiya Nyaya Sanhita, 2023 registered at Police Station City Malout, District Sri Muktsar, Sahib (Annexure P-1). 2. As per facts of the case, complainant Khushwinder Kaur gave her statement that she is home maker. Her sister Rajinder Kaur owned 2 marla land near Convent School, Malout which is a vacant plot for shop area 20x40. Jaswinder Singh and Darminder Singh sons of Sukhdev Singh claimed their right over this property without any basis. She had filed complaint against them which was under investigation. On 29.03.2025, Panchayat was convened but did not yield fruitful result. Singh, Pritam Kaur, Jaspreet Singh, Varun Pahwa and unknown women were standing near the property. They had hired masons and were constructing a wall by dividing vacant plot. She tried to stop them, thereupon Jaswinder Singh, Dharminder Sijngh, Jasmanjot Singh, Jaspreet Singh and Varun Pahwa pulled her and took her to the back of the plot and told masons to continue work. Aforesaid persons torn her clothes and touched her private parts. They slapped and tried to outrage her modesty. They rubbed her stomach and grabbed her face. Jaswinder Singh and Darminder Singh tried to remove her clothes. She raised alarm on which Dharminder Singh’s mother Pritam Kaur slapped and grabbed her hairs and pushed her towards unknown woman who hit her face with slippers and grabbed her and threw her on ground. Varun Pahwa had made video of this entire incident. She called the police and thereafter admitted in Civil Hospital, Malout. On the basis of aforesaid complaint, present FIR has been registered. 3. Counsel for petitioner argued that in pursuance 20.08.2025 petitioner has joined the investigation and fully cooperated with investigating agency.
He is ready to abide by the terms and conditions of bail
order.

Status report filed by the respondent – State is taken on record, subject to just exceptions. Copy supplied to the opposite counsel. It is pointed out that in the occurrence Khushwinder Kaur and Harjinder Kaur were two injured persons. also gave her beating. In pursuance of order passed by this Court, petitioner has joined investigation on 30.08.2025. Considering the gravity of offence, petitioner is not entitled to be released on anticipatory bail.

I have considered the arguments and have gone through the record. No recovery is to be effected from the present petitioner. He has already joined the investigation. No purpose would be served by sending him behind the bars. Therefore, without commenting on the merits, anticipatory bail application filed by petitioner is allowed. He be not arrested. In case of his arrest, he be released on bail to the satisfaction of Arresting/Investigating Officer concerned, subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave country without prior permission as provided under Section 482 (2) of BNSS, 2023.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
