Order No.02 Dated- 11/04/2025
Heard the parties.
Apprehending their arrest in connection with Ranga P.S. Case No.04 of 2025 instituted under sections 191(2), 191(3), 190, 115(2), 118(1), 117(2) and 109 of the B.N.S., 2023, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners were member of an unlawful assembly and in prosecution of common object of the assembly armed with deadly
weapons, the petitioner no.1 Ehsan Ansari assaulted Mubarak Ansari causing grievous injury on his head. It is submitted that the allegation against the petitioners is false. It is next submitted that the allegations against the rest of the petitioners are general and omnibus in nature. It is next submitted that wife of the co-accused has instituted Ranga P.S. Case No.06 of 2025 in respect of the self-same occurrence. It is further submitted that the petitioners are ready and willing to cooperate with the investigation of the case. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.
Learned counsel appearing for the State and the learned counsel for the informant on the other hand vehemently oppose the prayer for grant of anticipatory bail and submit that keeping in view the direct and specific allegation against the petitioner no.1 namely Ehsan Ansari of causing grievous injury on the head of Mubarak Ansari, hence, the custodial interrogation of the petitioner no.1 namely Ehsan Ansari is required during the investigation of the case in order to find out the details of the case and recovery of weapon of offence. It is, therefore, submitted that the petitioners ought not to be given the privileges of anticipatory bail. Considering the serious nature of allegation against the petitioner no.1 namely Ehsan Ansari, the requirement of his custodial interrogation during the investigation of the case, this Court is of the considered view that this is not a fit case where the petitioner no.1 namely Ehsan Ansari be given the privileges of anticipatory bail. Accordingly, the prayer for grant of privileges of anticipatory bail of the petitioner no.1 namely Ehsan Ansari is rejected. So far as the petitioner no.2 to 6 are concerned, there is no specific overt act attributed to any of them of causing any grievous injuries to anyone, therefore, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court below within six weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Rajmahal in connection with Ranga P.S. Case No.04 of 2025 with the condition that they will co-operate with the investigation of the case and appear before the investigating officer as
and when noticed by him and furnish their mobile numbers and photocopy of the Aadhar Cards with an undertaking that they will not change their mobile numbers during the pendency of the case and they will not annoy or disturb the informant in any manner during the pendency of the case and they will not to annoy or disturb the informant, victim or their family members in any manner during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
