By way of this Appeal, the appellant has assailed order dated 09.07.2025 passed by the learned Single Bench in CWP-4523-2019, whereby the assessed amount was ordered to be recovered from the appellant. 2. Learned counsel for the appellant contends that despite a request made by the appellant earlier in the year 2006, to convert the category of the appellant’s electricity connection from NRS to MS Category i.e. from commercial to industrial category, the authorities have continued to issue bills to the appellant as per commercial category which is much higher than the rate payable by the appellant. It is also submitted that on account of the order passed by the learned Single Bench, the respondents have discontinued the appellant’s electricity connection. 3. Learned counsel for the appellant has contended that it was for the unavoidable reasons that a prayer for adjournment was made in the matter before the learned Single Bench. Ms. Anu Chatrath, Senior Advocate, appears on behalf of the respondents, and does not dispute that as per the tariff fixed, tariff for commercial connections is on the higher side. She however states that this being a case of unauthorized use, demand raised by the respondents is valid. 5. We find that the Writ Petition is still pending before the learned Single Bench. The matter has already been fixed for 01.12.2025. In such view of the matter, we modify the order dated 09.07.2025 passed by the learned Single Bench and provide that the interim protection, granted earlier in the Writ Petition, shall continue, subject to the appellant depositing the current bills. The respondents shall also restore the electricity connection of the appellant within 48 hours. 6. We also record the undertaking of the learned counsel for the appellant that no further request for adjournment would be made and the matter shall be finally argued on the date fixed. 7. The LPA stands disposed of with the aforementioned observations. 8. All pending applications, if any, in this case are disposed of accordingly.
