1. Present petition has been filed under Section 528 of BNSS, 2023, for quashing of impugned order dated 17.07.2025 in case bearing No.SC/752/2023 pending before Ld. Additional Session Judge, Amritsar (Annexure P-13) in FIR No.10 dated 25.01.2023 under Section 379-B, 32, 411, 120-B of IPC, registered at Police Station Majitha Road, Amritsar vide which the bail bonds of the petitioner were forfeited to State and non-bailable warrants of arrest of petitioner has been issued.

Learned counsel for the petitioner submits that petitioner is suffering from tuberculosis of spine and due to this, he is unable to move. Petitioner moved an application for exemption but the same was declined by the trial Court and he prays for quashing of impugned order dated

4. Mr. Ravinder Singh, DAG, Punjab accepts notice on behalf of the State and submits that present petitioner is in habit to move such application(s) and not appearing before the trial Court and due to which the trial is lingering on. Learned State counsel also draws attention of this Court to the impugned order dated 17.07.2025 (Annexure P-13), wherein exemption to one accused was allowed and exemption to the present petitioner and his co-accused was dismissed on the ground that they are in habit of moving such application(s).

6. In view of the above, the present petition is hereby disposed of with a direction to the petitioner to surrender before the trial Court within a period of 15 days from today and learned trial Court will decide his application on merits after considering all the pleas raised before this Court.
