The petitioner has submitted an application under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (“the SARFAESI Act”) to the respondent no.1/District Magistrate, Haridwar, on 07.03.2025, but till date, no action has been taken on it. Therefore, the petitioner seeks directions that the respondent no.1/District Magistrate, Haridwar, may be directed to take a decision on the application that was submitted by the petitioner on 07.03.2025. Learned counsel for the petitioner submits that as per the provisions of Section 14 of the SARFAESI Act, such application has to be decided within a period of 30 days or at most, at the extended period of 60 days, but for more than four months, the application is pending before the respondent no.1/District Magistrate, Haridwar. Therefore, directions are required to be issued. Learned State Counsel gives a statement that within four weeks from today, the application that has been submitted by the petitioner shall be decided. The Court takes on record the statement given by learned State Counsel. The writ petition is disposed of with the direction to the respondent no.1/District Magistrate, Haridwar, to take a decision on the application given by the petitioner, within a period of four weeks from today, in accordance with law.
