JUSTICE NIRZAR S. DESAI Date : 11/12/2025 ORAL ORDER 1. Heard learned advocate Ms. R. V. Acharya, appearing for the petitioner. 2. The main grievance of the petitioner is that although the petitioner's mother died in the year 1999 and the petitioner’s application for compassionate appointment has been pending since 2005, the same has not been decided till date. It is further submitted that the petitioner has been serving on a contractual basis in the same organization for the last twenty years, and C/SCA/16792/2025 ORDER DATED: 11/12/2025 therefore, his case is required to be considered for compassionate appointment. 3. Learned advocate Ms. R. V. Acharya, under instructions, states that the grievance of the petitioner at this stage would be redressed if the respondents are directed to decide the representation already made by the petitioner in the year 2005; or, in the alternative, the petitioner may be permitted to make a fresh representation, and the respondents may be directed to decide the same in accordance with law and as per the policy applicable to the petitioner for compassionate appointment. 4. In view of the above, the petitioner is at liberty to make a fresh representation to respondent No.2. In the event such a representation is made by the petitioner within a period of two weeks from today, respondent No.2 is directed to decide the same within a period of three months thereafter, in accordance with law, by passing a reasoned order. 5. In view of the above directions, learned advocate Ms. R. V. Acharya, appearing for the petitioner, does not press C/SCA/16792/2025 ORDER DATED: 11/12/2025 this petition. Accordingly, the petition is disposed of as the petitioner is desirous of making a representation. It is clarified that this Court has not gone into the merits of the matter.
