This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue an appropriate writ order or direction more particularly one in the nature writ of mandamus to declaring the action of the 3rd respondent in keeping the land of the petitioner Ac 2 02 cents in Survey No.634/1A7 of Dhulipalla Village of Sattenapalli Mandal under 22-A as the Andhra Pradesh Gazette Part-IV B Extraordinary published by Authority Act No.35 of 2023 para 5 (1) is illegal, arbitrary and consequently to direct the 3rd respondent to consider the representation of the petitioner dated 02.12.2023 by removing the land of the petitioner of Survey
No.634/1A7 of Dhulipalla Village of Sattenapalli Mandal Palnadu District from 22A Prohibition of Transfer List from the records of Mandal Revenue Office Sattenapalli Palnadu District pass such other order or orders...”
2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. 3. The case of the petitioner is that the petitioner is the wife of Bandlamudi Veeraiah, an ex-serviceman who served in the Indian Signal Corps and allotted land admeasuring to an extent of Ac.2.02 cents in Sy.No.634/1-A7, situated in Dhulipalla village of Sattenapalli Mandal, Guntur District, vide DKT No.255/88 D-Form-(7), dated 05.11.1978. The Tahsildar also issued pattadar passbooks in favour of the petitioner in respect of the said property. 4. The learned counsel for the petitioner submits that the allotted land is still shown as being under the 22-A prohibition of transfer in the records of the Mandal Revenue Officer. In this regard, the petitioner submitted a representation to the District Collector on 27.03.2023, requesting that the land be updated in the online system so that the Adangal copy could be generated. The petitioner is unable to obtain an Adangal copy through the online system, and without it, the Registration Department is refusing to register the petitioner’s will in favour of her successors.
However, the respondents have not taken any action with respect to the subject property. 5. He further submits that, as per G.O.Ms.No.1117 dated 11.11.1993, lands allotted to ex-servicemen are eligible for transfer after a period of 10
years from the date of allotment. Therefore, the petitioner’s land should be removed from the 22-A (Prohibition of Transfers) list maintained by the revenue authorities of the Mandal Revenue Office. 6. The petitioner also submitted a representation to the Tahsildar on 02.12.2023, seeking for removal of the subject land from the 22-A list, through a Mee-Seva application dated 29.11.2023. However, even after receipt of the representation, the respondents have neither considered the representation nor issued any proceedings in her favour. Hence, the present Writ Petition. 7. The learned Assistant Government Pleader for Revenue appearing for the respondents submits that the respondents authorities will consider the representation of the petitioner dated 02.12.2023 and pass appropriate orders within a reasonable time in accordance with law. 8. Having regard to the submissions made by learned counsel for the petitioner and learned Government Pleader for the respondents, on perusal of the material available on record, this Court is of the considered view that the present Writ Petition can be disposed of, by directing the 2nd respondent herein to consider the representation of the petitioner dated 02.12.2023 and pass appropriate orders in accordance with law within a period of four (04) months, from the date of receipt of copy of this order. 9. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
