Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Case No. 5494 of 2022, titled State Vs. Hargovind, arising out of Case Crime No. 88 of 2021, under Sections 323, 498-A, I.P.C., Police Station Kagaraul, District West Commissionerate Agra, pending before the Additional Civil Judge, J.D., Court No.8, Agra to the court of competent jurisdiction at Mathura. Concededly, the applicant herself had filed the above case against the accused persons-opposite party nos.2 to 5 at Agra, which is pending trial, who seeks transfer of the subject case on the ground that the accused persons are threatening the applicant, and they forcibly got signed a compromise from her on 13.12.2023. In this regard, a complaint by the applicant has been given to the Police Commissioner, Agra. A perusal of the complaint dated 16.12.2024 would show that the alleged signature of the applicant was obtained by the accused a year back on 13.12.2023 and during the course of hearing, no explanation has been offered for delay in lodging the complaint. Further, it has also not been disputed by learned counsel that the said compromise has never been used by the accused-opposite party nos.2 to 5 in any of the pending cases between the parties. The application is dismissed.
